Have you ever been in a car accident and just guessed on what to do next? Well now you don’t have to. I am going to give you 5 mistakes to avoid after an accident, with tips on what to do next. 


The laws in Alabama can be tricky at times when it comes to speaking. What you say after a wreck can make or break things in the courtroom. Whatever you say can be used against you and may even cause you to not receive compensation from the insurance company. 


  1. Never admit fault 

  2. After a wreck don’t say “I’m sorry”. I know it can be difficult but it can also be used against you even if it was not your fault

  3. Don’t say what you did or didn’t do

  4. Don’t agree with the other person on what happened

Ultimately the less you say the better. Insurance companies will look for anything to shift the blame on to you. 

  1. Fail to call the police

  2. Call 911

  3. Give statement

  4. Witness statements 

In Alabama, it is the law to call the police. If the crash is bad enough the Alabama Law Enforcement Agency may investigate. Without a proper police report, insurance may be harder to cooperate with. 

  1. Denying/Delaying Medical Treatment 

  2. Any pain/discomfort 

  3. Wiplash 

  4. Injuries Worsen 

Some symptoms do not show immediately. Always get checked out by EMS even if you think you may be okay. If you have symptoms that show up later but did not get checked out on site, insurance may not cover it fully if you have to make a visit to the ER. 

  1. Speak to the insurance company without proper paperwork

  2. Statements that have been written down and recorded

  3. Police report 

  4. Medical bills 

When speaking to the insurance company make sure that you do not fall into their traps. Make sure that everything is taken care of by being prepared with all the paperwork and proper documentation. 

  1. Take legal action 

  2. Call the police

  3. Make the injury claims

  4. Call the insurance company 

In the state of Alabama you have two years to file a lawsuit against someone after a wreck. If you do not make the claim within those two years the chance of compensation is gone entirely. 


The state of Alabama can have some nooks and crannies within the system when it comes to being in a wreck. Make sure that you do not fall within the cracks. Know your rights, take action, and fight for yourself.
